Inaugural Symposium to Address Construction Adjudication in Canada

The Ontario government is introducing an adjudication process to ease the strain of delayed payment and expensive dispute resolution processes in the construction sector. Other Canadian juridictions, including the Federal government, are reviewing similar initiatives.

As modern construction projects have become increasingly complex, dispute resolution has become a time-consuming ordeal for the industry. Canada is looking to other countries' experiences as examples of how a formal adjudication process can facilitate payment disputes for everyone involved.

The CIQS has continued its active participation in the process leading to the proposed federal prompt payment reforms by providing a Stakeholder Submission and following with verbal presentation at meeting in advance of a report prepared for Public Services and Procurement Canada titled “Building a Federal Framework for Prompt Payment and Adjudication” delivered on June 8, 2018 by R. Bruce Reynolds and Sharon C. Vogel with the Secretary of the Review being James K. Little.

Presentation Summary

When Martyn Phillips started out in the engineering profession, formal project management systems were few and far between. Now there are management systems for just about everything. Yet today, projects still go awry and significant value can be lost, due to scope increases, cost overruns, schedule & approval delays and general stakeholder dissatisfaction.

Martyn has been conducting formal, performance and cost optimization methods for many years. His presentation overviews how they are applied to great effect to business and strategic planning for regional improvements; feasibility, options identification, concept selection/definition; design and constructability improvements as well as revitalization/upgrading and major retrofit work. Examples from applications around the world will be discussed.

Martyn R. Phillips, Value Improvement SpecialistMartyn Phillips, FICE, FCIWEM, FHKIVM, FSAVE, CVS-Life, P.Eng., PVM Martyn Phillips has a long history of project development and implementation. As well, he has been leading formal value planning and improvement assignments for over 25 years. His technical background lies in process improvement and civil engineering. His leadership of group problem-solving situations, innovative enhancements and organizational effectiveness assignments has resulted in significant savings of time and cost, together with functionality enhancements and risk reduction, for a number of high-profile undertakings in various countries.

His guidance in identification of opportunities for functionality improvements, schedule optimization, risk reduction and cost avoidance, has led to savings of many hundreds of millions of dollars. For example, $100 Mn. CAPEX saving and functionality enhancement at the tendering stage of an EPC offshore project.

Martyn is also a pioneer in the field of value assurance as a strategic planning and oversight process. He has written a suite of eight books (including one e-book) on the various facets of value improvement.

Martyn is qualified as a Certified Value Specialist-Life (US), a Professional in Value Management (in Europe) and a Professional Engineer (Canada). He is also a Fellow of: a) the Institution of Civil Engineers (UK); b) the Chartered Institution of Water and Environmental Management (UK); c) SAVE International (US); and d) the Hong Kong Institute of Value Management.

In 2012 Martyn received the Value Analysis Canada’s Award for Innovation; in 2018, he received the Canadian Value / Life Value Achievement award.

He is also the Director of Global Affairs on the Executive Board for SAVE International.

NOTICE IS HEREBY GIVEN that a special meeting of the Members of CIQS – Ontario will be held at 90 Nolan Court, Unit 19, Markham, ON., on the 23rd day of March 2019 at 10:00 a.m.

  1. To consider and, if thought advisable, to pass, with or without amendment, a Special Resolution:
    • authorizing the amendment of the Articles of CIQS – Ontario to change the statement regarding the distribution of property remaining on liquidation;
      confirming By-law No. 2, as enacted by the directors;
    • authorizing CIQS – Ontario to terminate its Affiliation Agreement with Canadian Institute of Quantity Surveyors; and
    • authorizing and directing the officers and directors of CIQS – Ontario to take appropriate measures to wind up and dissolve CIQS – Ontario.
  2. To transact such further or other business as may properly come before the meeting or any adjournment or adjournments thereof.
